Professional Experience

Yarden Gershony’s practice is devoted to complex commercial litigation and arbitration.

He began his career with Shearman & Sterling, a top international arbitration firm based in New York, where he acted as arbitration counsel in numerous significant disputes, including representing the successful party in winning the then-largest arbitration award in history. He then joined McCarthy Tetrault in Vancouver, where he continued practicing commercial litigation and arbitration at a high level. Yarden is now a partner at Rush Ihas Hardwick LLP, the leading dispute resolution boutique in the BC Interior. Yarden is based in Kelowna and travels regularly to Vancouver in the course of his practice.

Yarden has significant experience acting as arbitrator in commercial domestic cases. As arbitrator, his goals are to provide the highest level of professional service to the parties and to craft a dispute resolution process that is as efficient as possible in each case.

Dispute Resolution Experience and Training
  • Five years as arbitrator in domestic commercial cases (ten appointments, five written awards).
  • Three years as counsel in large international arbitrations and arbitration-related litigation, with hundreds of millions or billions of dollars at stake.
  • Four years as commercial litigation counsel in New York’s state and federal courts.
  • Twelve years as counsel in corporate-commercial litigation based in BC (trials, appeals, judicial reviews) with amounts at issue ranging from ~$100,000 to ~$50 million.
  • Pro bono includes writ of certiorari before the US Supreme Court in a death row appeal.
  • Twelve years as counsel in arbitrations under the BC Arbitration Act and BCICAC rules (now VanIAC).
  • Litigation and arbitration-related professional presentations for the Continuing Legal Education Society of BC, the Canadian Bar Association, the Young Canadian Arbitration Practitioners, VanlAC, TRU Law School and others.
